TERMS & CONDITIONS

Please carefully read the Terms and Conditions that apply between www.accommodation-valencia.com, owned by Frederic Giraud 000642624D SLNE Unipersonal and you (the guest) for the booking of your accommodation in Valencia for the purposes of short-term holiday or executive rental accommodation. The www.accommodation-valencia.com website is owned and managed by ACCOMMODATION-VALENCIA, a (private) limited company registered in VALENCIA SPAIN (Chamber of Commerce of Valencia. CIF B 897511604 - Tomo 7865. Libro 5 Folio 114. Hoja V-149. Licence EEAT-134-V)

1. General Conditions

We rent our apartments on a short-term basis and all prices shown are in Euros, VAT included. All reservations are made via the website and apartment availability is shown in real time. Accommodation Valencia has exclusivity with the apartments listed. No other agency has rights to these properties. Each quotation includes electricity, water, heating, air-conditioning (if provided) and the assistance of our staff during your check-in and your stay. Therefore, for bookings more than two months, electricity, water and gas meters will be read, and the client will be charged. The final cleaning charge, linen and towels are not included in the rental price.

2. Optional services

Linen, towels, and final cleaning are NOT included. You can request them online directly when you book your apartment. All prices are indicated during the booking process A foldable crib (baby bed) can be hired online. The apartment will be clean and tidy; you are free to include contract the final cleaning service charge or to leave the apartment as clean as you find it. If a final cleaning necessary, we will deduct a cleaning fee from your security deposit.

3. Payment and booking conditions

You must be 18 years of age or older. A minimum of 3-night booking is required for any reservation. Our database will accept a reservation on the basis of the availability of the apartments. The reservation will be confirmed by Accommodation-Valencia after the payment of the deposit. The terms and methods of the payment are as follows: All reservations must be confirmed with a deposit equal to 30% of the total charge for the entire stay of the reservation. This payment may be made by credit card online or by bank transfer within 24 hours after your booking. When the payment is made by credit card the booking is confirmed immediately Failure to make the bank transfer in 24 hours may result in cancellation of your booking. Please note that the guest will bear all charges for the bank transfer. If you pay by bank transfer, please send within 24 hours a copy of your transfer payment’s receipt to our fax number +34 963 382 384 or a scanned copy by email, specifying the number of your booking, the reference of the apartment and your name. For bookings/leases longer than 8 weeks, the initial 8 weeks/2 months rental has to be paid in advance, and rental is billed monthly in advance thereafter. The remaining 70% is to be paid in cash or by credit card (which has an added bank fee of 3%) when you arrive at our office for check-in, as well, we require a security deposit of 300 € to be paid as well only in CASH on your arrival date. IMPORTANT Late Bookings made less than 24h00 prior your arrival, after 12am for the same arrival date, or bookings made Friday after 12:00 am for the same day arrival or for the same Saturday or Sunday, must be communicated to the office by telephone and must be confirmed by our office. In the case of same day booking and arrival ,the bank transfer payment receipt must be sent before 12am of your arrival date (not applicable for Saturday and Sunday) . Failure to make this payment by the specified date may result in cancellation of your booking. Reservations not confirmed by our office, will not be refunded in the event of cancellation.

Failure to send the bank transfer receipt within the specified deadline may result in an automatic cancellation of your booking. Please note that the reservation is not guaranteed until you receive the confirmation from us. We will not issue the confirmation until we receive all documents by fax or by email. In the case that the check in occurs at the rental property, payment by credit card is not an option.

4. Security deposit

A security deposit of 300 € to 700 €, depending on the apartment, is required. This deposit is against possible damages or losses caused to the Property. It is payable to our staff on arrival, and only cash is accepted. Accommodation-Valencia will provide the keys to the apartment only on receipt of the security deposit. The security deposit is charged on arrival and is fully refunded within seven working days after departure, unless there are outstanding charges in the case of damage or loss to the property during your stay or other fees and services that must be added after your departure. The client will bear the bank fees. Additional charges will be deducted from the security deposit and the difference refunded to you. In all cases, the client accepts without reservation that the charges for damage / disaster / loss / unadvised delay in arrival / cleaning fees are directly deducted from the deposit given at the arrival according to the table displayed at Accommodation Valencia office and according to our staff’s report after departure of the client. The deposit will be sent within 8 working days after departure or more in case there is mistake or incomplete data in the bank details communicated to Accommodation Valencia. IMPORTANT : All data necessary to make the transfer of the deposit on due time (IBAN +SWIFT) must be correct. If erroneous or missing values occur the beneficiary bank will take transfer fees to refund the money to the ordinary bank. The client will bear the bank fees and the company can not be responsible for that. The company cannot be held responsible for fees taken from the beneficiary bank.

5. Rules for clients

The apartments can only be used for temporary and tourist household needs. You cannot make the apartment your new place of residence or choose it as your permanent residence. It is furthermore not allowed to sublet the apartment, or parts of it, to third parties. The said premises or any part thereof shall not be used for any purposes other than as residential accommodation. Immoral or commercial activity is strictly forbidden. All building rules and regulations must be observed. Between 1 p.m. and 3 p.m. and 10 p.m. and 9 a.m. apartment occupiers shall not make any loud noises. Animals are not admitted in the lodgings unless other agreements have been made. In the event that you do not follow Accommodation-Valencia’s and the building rules and regulations (such as noise during the above mentioned hours, etc.), Accommodation-Valencia reserves the right to cancel this contract and to vacate you immediately from the apartment without having to refund you for the remaining days and keeping the totality of the security deposit as a penalty. Accommodation-Valencia will require additional charges (see Surcharges list displayed at the office) in case you require the presence of our local staff during your stay for reasons such as losing the apartment's keys, forgetting the keys inside the apartment or for unjustified emergency calls to the agent for assistance in the property. list non exhaustive. Guests are not permitted to interfere, cause or permit interference with the reasonable peace, comfort and privacy of neighbours. No parties or loud music are allowed in the apartment. The client shall comply with the By-Laws applicable with respect to the premises and its environment. The client must not mark, paint, drive nails, screws or the like into, or otherwise damage or deface, any structure that forms part of the common property without the approval in writing of the owners. In the case of default, Accommodation-Valencia may arrange repairs and a fee may be charged. No animals or birds can be kept on the premises without the previous authorization of Accommodation-Valencia. Use or storage of inflammable, explosive, corrosive or radioactive materials is strictly forbidden. It is forbidden to use any appliance, which may increase the consumption of electricity, water or gas, without the previous authorization of Accommodation-Valencia. No furniture or effects can be removed from the premises and proper care has to be taken of all items included in the letting. The guest agrees to return all keys and operating devices when the agreement terminates and give vacant possession of the premises to the Accommodation-Valencia office at the check out time (see §9). The client is responsible for any cost of replacement for access cards (e.g., proximity tag or card, car park remote control) and keys. Accommodation-Valencia agents are allowed to enter, view the state of repair and carry out repairs even in the absence of the tenant. Accommodation-Valencia is authorized to show the premises to prospective buyers, mortgagers or prospective tenants on a reasonable number of occasions, provided the tenant gets reasonable notice on each occasion. Failure to fully disclose (or misrepresentation of) such occasions is cause for immediate cancellation of the reservation with the forfeiture of all funds and guest’s immediate eviction of the premises. Accommodation-Valencia reserves the rights to deny occupancy, evict or refuse refund at any time to anyone who appears to be detrimental to the property.

6. Number of persons

We are entitled to refuse admittance to the persons exceeding the number on the booking form or the number of beds of each apartment, except for children under two years of age. Nobody else is admitted to stay in our apartments authorization. In the event of any infringement of the aforementioned obligations, Accommodation Valencia at its sole discretion will be entitled to request the client to leave the apartment immediately, and the client shall have no right to claim any type of compensation.

7. Cleaning Policy

On arrival you will find your property clean and tidy. The final cleaning is not included in the rental price. If you choose not to include the final cleaning, you are requested to tidy and to do a complete cleaning of the apartment (the kitchen, wash and put away all dishes, empty refrigerator, take out the garbage, bathrooms…) before departure. You are asked to leave the apartment as you found it. If a final cleaning is necessary after your departure, we will deduct 200% of the final cleaning fee from your security deposit.You can request an optional final cleaning to be added when you make your reservation,. Please note that for any booking of 30 nights or more, a compulsory cleaning fee will be charged to the client. If you choose to include the final cleaning, you are requested wash and put away all dishes, empty refrigerator, and take out the garbage. If you do not, the difference between the cleaning penalty and the final cleaning fee paid will be deducted from the deposit. In the case that an accommodation is not clean at the time of the arrival, you have 2 hours to inform us via email text message or phone call (leaving a message). We will send our cleaning staff as soon as possible and you will be compensated.. (Reimbursements will only be done by bank transfer within 15 days after the end of the contract) The cost of cleaning services is available online and listed in our office.

8. Arrivals

Accommodation-Valencia will inform you of your apartment’s address. Accommodation-Valencia’s agent will meet you at the office and hand over the keys. Remember to contact our staff in order to schedule a time for a meeting at the office. It is essential that you inform Accommodation-Valencia of your estimated time of arrival in Valencia, at least 4 days prior arrival. In case of delays exceeding half an hour over the agreed time you will have to contact our agent. If you fail to do so, we are allowed to charge a Delayed Arrival Fees (see Surcharges list in confirmation email and displayed at the office). If Accommodation-Valencia has not been informed of long delays and the client misses the check-in at the office, Accommodation-Valencia is not responsible. Requests for night-time arrivals (later than 8 pm) have to be confirmed by Accommodation-Valencia. In this case you will have to pay a surcharge for late arrival service (see Surcharges list in confirmation email and displayed at the office) to our staff. For any check-in you will leave a security deposit and sign the contract. Upon arrival the guess will find at the apartment a complete inventory of furniture of the premises. This will have to be verified and any discrepancies brought to the notice of Accommodation-Valencia within 24 hours. Please note that this notification has to be done either by email, fax or by filling in the form at the office. We recommend that you to keep a receipt of the written notice . If no notification is received within the stipulated time, it will be deemed that the inventory is accepted. If you find that an item in the inventory is damaged or absent, you must report it within 24 hours after your arrival, otherwise Accommodation-Valencia will not be responsible for such item and the client will pay Accommodation-Valencia for the cost of repair or replacement. Accommodation-Valencia will have to be notified as soon as practically possible of any damage to the premises. This will facilitate the replacement of articles, furniture, effects or fittings that may be damaged or lost during the period of tenancy. Check in time is from 4 pm (16h00) until 8pm (20h00) on the day of arrival For arrival on Saturday and Sunday , the check in time has to be made in advance with Accommodation-Valencia. In the event of late arrival, you will be charged a supplementary fee depending on the time and are accumulative: 30 € after 8pm to 10pm (20h00 to 22h00) 50 € after 10pm to 12pm (22h00 to 00h00) There is no check-in possible after 12.00 pm (00h00) Check-in on Sundays is an additional 30 euros. You can arrange for an earlier check in via email, however, this will depend on whether or not the apartment is ready. We do not provide storage for luggage if you arrive early.

9. Departures

Kindly make all arrangements for the departure well in advance. Check out is at 12.00 am on day of departure, at Accommodation-Valencia´s office. You will need to be at the office by 12.00am. Late departure will be charged 3 times the daily rate. In the case that the departure hour has been agreed upon and that the client is not physically present at the office on the determined hour to return the key, Accommodation Valencia will proceed to the change of the lock for security reasons; Surcharges list displayed at the office. In the case that the departure hour has not been agreed upon, the default departure hour is 12.00am and the same process will be followed if the client has not come to the office. In both cases the cost of late departure and lock change will be deducted directly from your security deposit. Please inform the office on your arrival date, whether you will check out before the opening hour of the office and cannot bring back the key to the office. For early departure, Saturday and Sunday departure, you will leave the key inside the apartment. If you leave the apartment before your departure date you will not be entitled to any refund or compensation.

10. Change of reservation

In the event that the client changes the dates, it will be understood as a new stay and it shall be subject to the cancellation conditions. Any request of extension of the stay should be sent to Accommodation-Valencia as soon as possible. If an apartment is available, the additional charges will be calculated on the basis of one-day rental with an additional night.

11. Cancellation Policy

All reservations are non-exchangeable, non-refundable and non-transferable except as provided under these Booking Terms and Conditions. In the event of a cancellation, Accommodation-Valencia is to be notified by fax or email as soon a possible and prior to the date of arrival. The cancellation charges will be calculated as follows: - A 50 Euro administration fees will be charged if cancellation occurs 90 days prior your intended arrival. - Cancellation within 61 to 90 days of your reservation date is subject to a cancellation fee of 30% of the pre-payment. - Cancellation within 31 and 60 days of reservation date is subject to a cancellation fee of 60% of the pre-payment. - Cancellation within 30 days of reservation date is subject to a cancellation fee of 100% of the pre-payment. The refund will be calculated on the basis of the rental price, minus the booking fees. Nevertheless the additional services will not be refunded. The guest will bear the bank charges for the transfer of the refund. Accommodation-Valencia is not responsible for cancellation due to circumstances beyond one’s control which shall include strike, natural calamities, disease, death, war (non exhaustive list), and consequently the client has to make the payment and undertake to cancel the booking following the cancellation policy (see §11.) on our Booking Terms and Conditions.

12. Cancellation from Accommodation-Valencia

Accommodation-Valencia can cancel any reservation at any time if the property booked is not available on the date of arrival or during the stay. In this case, Accommodation-Valencia will refund totally the pre-payment. Accommodation Valencia should be unable to provide to the client the property he has booked, they reserve the right to transfer him to a property of similar characteristics. In the event that the client is not in agreement with the offered property, all monies paid will be refunded.

13. Loss of booking and pre-payment

If you do not show up on the arrival date, the reservation will be deemed cancelled. If we are notified of your delay 48 hours prior to arrival, we will hold your reservation for one more day. The apartment will be considered to have been occupied from the original date of arrival. You will not be entitled to any extension on your original booking.

14. Contract

The contract signed with Accommodation-Valencia is for short term rentals of a furnished apartment which is subject to the Urban Letting Law (la Ley de Arrendamientos Urbanos,Ley28/1994). These contracts do not permit the apartment to be let as a "permanent residence" of the tenant. Only short-term rentals for travel, holidays, studies, temporary stays, etc. are allowed.

15. Entitlements and obligations

Accommodation-Valencia will provide all relevant information. Accommodation-Valencia formalizes the reservations and contract procedure. Accommodation-Valencia verifies the inventory and payment. The owner of each apartment cedes its use for letting, under the indicted legal and contractual rules and conditions usual in these cases. The guest has the right to occupy the apartment for the period contracted, with the number of people previously agreed upon and is obliged to pay the rental price and take responsibility for any irregularities caused to the apartment in this period.

16. Liability

In the case of technical problems, you are kindly requested to contact Accommodation-Valencia on the date of arrival to resolve any problem as soon as possible. Accommodation-Valencia will have to be provided sufficient time to solve the problem. Accommodation-Valencia will not be held responsible for possible harm done to you during your stay. Accommodation-Valencia is not responsible for any loss, delay or damage caused by circumstances beyond its control (such as flooding, explosions, storms, fires, strikes, bad weather conditions, wars or war threats, civil problems, acts, restrictions, regulations or measures of any type from the government or the local authorities). Moreover, Accommodation-Valencia is not responsible for breakdowns of pumps or boilers or interruptions of the water or electricity supply by the local supplier. Accommodation-Valencia is not liable under any circumstances for loss, theft or damage to the occupants or clients and/ or their property and belongings. In the case of a major problem in the rented apartment, for example cut electricity or water, Accommodation Valencia agrees to reimburse the client according to the discount agreement (displayed the Accommodation Valencia office). In all other cases, Accommodation Valencia will organize the reparation or replacement of the stated object/equipment within 48 hours (working days) of reporting the problem. In cases where the problem cannot be resolved, Accommodation Valencia will then take into account the necessary reimbursements according to the stated discount agreement (displayed in the Accommodation Valencia office). All reimbursement/compensation will be carried out via bank transfer within 15 days after the end date of the contract.

17. Legal information

The rental contracts are subject to Spanish legislation, to be exact, Ley 28/1994, Ley de Arrendamientos Urbanos (the Law for Urban Lettings) and the Código Civil (the Civil Code), and for prosecution matters to Ley 1/2000, Enjuiciamiento Civil (Lawsuit), under which the competence will correspond to the exclusive jurisdiction of the courts of Valencia, Spain.

18. Equipment of the properties

Linen and towels are available upon request. It is strictly forbidden to sleep on the beds without linen. The apartment is equipped with the basic kitchen utensils and dishes and silverware for the designated number of persons, refrigerator and burners (electric and gas). Apartments considered to have a heating system are those which main rooms (living room and bedrooms) are heated with a hot air conditioning system or an electric convector heater. Apartments considered to have a Hi Fi system are those which have at least a CD lector and a sound system. The photos present on this site, are non contractual and can be submitted to updating.

19. User agreement

By confirming your reservation with Accommodation-Valencia you agree to our term and conditions as outlined above. You acknowledge reading and accepting our cancellation policy as stated. In accepting our terms and conditions and you will be expected to abide by these rules. You will also be expected to sign these rules upon check-in on your arrival day.

20. Website Ownership

The present conditions regulate the allowed use of the Web Site www.accommodation-valencia.com, that Accommodation-Valencia, Fiscal ID Number: B 897511604 Registered at the Chamber of Commerce of Valencia. Tomo 7865. Libro 5 Folio 114. Hoja V-149. Licence EEAT-134-V respecting the content of the following laws 9, 23 y 24 del Decreto 30/1993, of the 8th of March, of the Valencian Government.
